WRAP驗廠原則符合工作時間規定

每日(ri)工作小時及每星期日(ri)數不得超過(guo)生產制(zhi)造商(shang)所(suo)在國的法定限制(zhi)。除(chu)非因要應(ying)對緊急業(ye)務需要,縫制(zhi)產品制(zhi)造商(shang)須每星期為職工提(ti)供一日(ri)休息。

工廠原則:
公司(si)遵守適用(yong)法律及行(xing)業標(biao)準有關工作(zuo)時(shi)間(jian)的(de)規(gui)定。

實施細則:
1、為配合原則六的實施,公司根據《中華人民共和國勞動法》
(1994)第(di)36條規(gui)(gui)(gui)(gui)定(ding)(ding)(ding)(ding):國家實行每日(ri)(ri)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)時(shi)(shi)間不(bu)超(chao)(chao)過8小(xiao)時(shi)(shi)、平均每周工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)時(shi)(shi)間不(bu)得超(chao)(chao)過44小(xiao)時(shi)(shi)的工(gong)(gong)(gong)(gong)(gong)時(shi)(shi)制度(du)及《國務院關(guan)于(yu)職(zhi)工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)時(shi)(shi)間的規(gui)(gui)(gui)(gui)定(ding)(ding)(ding)(ding)》(1995)第(di)3條規(gui)(gui)(gui)(gui)定(ding)(ding)(ding)(ding)標(biao)(biao)準(zhun)(zhun)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)日(ri)(ri):職(zhi)工(gong)(gong)(gong)(gong)(gong)每日(ri)(ri)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)8小(xiao)時(shi)(shi),每周工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)40小(xiao)時(shi)(shi)。《中(zhong)華人(ren)民(min)共和(he)(he)國勞(lao)(lao)動(dong)(dong)法(fa)》37條規(gui)(gui)(gui)(gui)定(ding)(ding)(ding)(ding):對(dui)計(ji)件(jian)(jian)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)日(ri)(ri)所作(zuo)(zuo)的規(gui)(gui)(gui)(gui)定(ding)(ding)(ding)(ding)如下(xia):“對(dui)實行計(ji)件(jian)(jian)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)的勞(lao)(lao)動(dong)(dong)者,用(yong)人(ren)單(dan)位應(ying)當(dang)根(gen)據(ju)本法(fa)第(di)36條規(gui)(gui)(gui)(gui)定(ding)(ding)(ding)(ding)的工(gong)(gong)(gong)(gong)(gong)時(shi)(shi)制度(du)合理確(que)定(ding)(ding)(ding)(ding)其勞(lao)(lao)動(dong)(dong)定(ding)(ding)(ding)(ding)額和(he)(he)計(ji)件(jian)(jian)報(bao)(bao)酬標(biao)(biao)準(zhun)(zhun)”。據(ju)這一規(gui)(gui)(gui)(gui)定(ding)(ding)(ding)(ding),計(ji)件(jian)(jian)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)日(ri)(ri)應(ying)有合理的勞(lao)(lao)動(dong)(dong)定(ding)(ding)(ding)(ding)額和(he)(he)計(ji)件(jian)(jian)報(bao)(bao)酬標(biao)(biao)準(zhun)(zhun)。而合理的勞(lao)(lao)動(dong)(dong)定(ding)(ding)(ding)(ding)額,應(ying)當(dang)以職(zhi)工(gong)(gong)(gong)(gong)(gong)在一個(ge)標(biao)(biao)準(zhun)(zhun)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)日(ri)(ri)(每日(ri)(ri)8小(xiao)時(shi)(shi))或標(biao)(biao)準(zhun)(zhun)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)周(每周不(bu)超(chao)(chao)過44小(xiao)時(shi)(shi))的工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)時(shi)(shi)間內能夠完成的計(ji)件(jian)(jian)數量為標(biao)(biao)準(zhun)(zhun),超(chao)(chao)過這個(ge)標(biao)(biao)準(zhun)(zhun)就等(deng)于(yu)延長了工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)日(ri)(ri)時(shi)(shi)間,侵犯了職(zhi)工(gong)(gong)(gong)(gong)(gong)的休(xiu)(xiu)息權。由公(gong)司(si)工(gong)(gong)(gong)(gong)(gong)會、辦公(gong)室(shi)負責(ze)制訂公(gong)司(si)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)和(he)(he)休(xiu)(xiu)息時(shi)(shi)間。

2、為配合原則六的實施,公司根據《中華人民共和國勞動法》
第43條規定(ding)(ding):用(yong)人單位(wei)不(bu)得違反本法規定(ding)(ding)延長勞(lao)動者的(de)工(gong)(gong)(gong)作時間。WRAP驗廠《中華人民共(gong)和(he)國勞(lao)動法》第一(yi)章(zhang)、第四章(zhang)有(you)關規定(ding)(ding),在保(bao)障職工(gong)(gong)(gong)身體健康并充分聽取職工(gong)(gong)(gong)意見的(de)基(ji)礎上(shang),采用(yong)集中工(gong)(gong)(gong)作、集中休(xiu)息、輪休(xiu)調休(xiu)、彈性(xing)工(gong)(gong)(gong)作時間等適當方式(shi),確保(bao)職工(gong)(gong)(gong)的(de)休(xiu)息休(xiu)假權利和(he)生產、工(gong)(gong)(gong)作任務的(de)完成。各分廠、部(bu)門負責根據(ju)公司工(gong)(gong)(gong)作和(he)休(xiu)息時間的(de)規定(ding)(ding)制訂生產計劃,合(he)理安排工(gong)(gong)(gong)人的(de)工(gong)(gong)(gong)作和(he)休(xiu)息時間。

3、為配合原則六的實施,公司根據《中華人民共和國勞動法》
第(di)39條規(gui)定:企(qi)業因生(sheng)產(chan)特(te)點不能實得(de)本法第(di)36條、第(di)38條規(gui)定的,經當地(di)勞動(dong)(dong)行政部門批準(zhun),可以實行其它工作和休(xiu)息辦(ban)法。遇有特(te)殊(shu)情(qing)況(應(ying)急業務需要)而需延長加班時間時,由辦(ban)公室負責向當地(di)勞動(dong)(dong)局申請,獲得(de)勞動(dong)(dong)局書面同(tong)意,職工在《自(zi)愿加班聲明書》上簽字確認方可,不得(de)強迫工人加班。

4、為配合原則六(liu)的(de)(de)(de)實施,公司根(gen)據第44條規定:有(you)下列情形之一的(de)(de)(de),用(yong)人單位應當按照下列標準支付勞(lao)(lao)動(dong)者延長(chang)工(gong)作(zuo)時間的(de)(de)(de)工(gong)資(zi)(zi)(zi)(zi)報(bao)酬:(1)安(an)排(pai)勞(lao)(lao)動(dong)者延長(chang)工(gong)作(zuo)時間的(de)(de)(de),支付不(bu)低于工(gong)資(zi)(zi)(zi)(zi)的(de)(de)(de)百分之150%的(de)(de)(de)工(gong)資(zi)(zi)(zi)(zi)報(bao)酬;(2)休息日安(an)排(pai)勞(lao)(lao)動(dong)者工(gong)作(zuo)又不(bu)能(neng)安(an)排(pai)補休的(de)(de)(de),支付不(bu)低于工(gong)資(zi)(zi)(zi)(zi)的(de)(de)(de)200%的(de)(de)(de)工(gong)資(zi)(zi)(zi)(zi)報(bao)酬;(3)法(fa)定休假日安(an)排(pai)勞(lao)(lao)動(dong)者工(gong)作(zuo)的(de)(de)(de),支付不(bu)低于工(gong)資(zi)(zi)(zi)(zi)的(de)(de)(de)300%的(de)(de)(de)工(gong)資(zi)(zi)(zi)(zi)報(bao)酬。

5、為配合原則六的實施,公司根據《中華人民共和國勞動法》驗廠輔導
第38條規定:用人單位在下列節日期間應當依法安排勞動者休假:(1)元旦;(2)春節;(3)國際勞動節;(4)國慶節;(5)法律、法規規定的其它休假節日。《全國年節及紀念日放假辦法》(1999)第2條規定全體公民放假的節日(1)新年:放假1天(1月1日);(2)春節:放假3天(農歷正月初一日、初二日、初三日);(3)勞動節:放假3天(5月1日、5月2日、5月3日);(4)國慶節:放假3天(10月1日、10月2日、10月3日)。第3條規定部分公民放假的節日及紀念日:(1)婦女節(限于婦女):放假半天(3月8日);(2)青年節(14周歲以上的青年):放假半天。第6條規定,全體公民放假的假日,如果適逢星期六、星期日,應當在工作日補假。部分公民放假的假日,如果適逢星期六、星期日,則不補假。由各分廠、部門負責合理調度安排生產,確保所有職工能得到其規定的休息。
